Los acuerdos entre el Estado Español y la Santa Sede: algunas cuestiones a tener en cuenta en su futura revisión

Abstract

Van a cumplirse cuatro décadas desde la firma de los Acuerdos entre el Estado español y la Santa Sede en 1979, y en este tiempo España ha vivido cambios políticos y sociológicos, incluyendo una evolución de nuestro ordenamiento jurídico, y todo ello tiene su repercusión en estos Acuerdos. En este trabajo se realiza una reflexión sobre algunas cuestiones reguladas en ellos, como los efectos civiles del matrimonio canónico, la enseñanza de la religión católica o la cooperación económica, que tienen una gran importancia en la garantía y promoción de la libertad religiosa, y que entendemos deberían ser objeto de revisión.

Four decades will be fulfilled since the signing of the agreements between the Spanish State and the Holy See in 1979. In this period, Spain has experienced political and sociological changes, including an evolution of our legal order, and all these changes have an impact in those agreements. This essay is a dissertation about some issues regulated in those agreements, as the civil effects of canonical marriage, the teaching of the Catholic religion or economic cooperation, which have a great importance in the guarantee and promotion of religious freedom, and we believe that they should be checked.
