Does general theory of law exist without moral values?

Abstract

El artículo aborda la Teoría general actual del Derecho con respecto a la necesidad de valores morales. El énfasis se centra en ocho argumentos que revelan por qué la Teoría general del Derecho en la cultura occidental se basa en valores morales. Se analiza cómo los valores morales son obligatorios para crear una Teoría general del Derecho, porque los individuos actúan moralmente en su vida diaria. Por lo tanto, distinguen una sentencia o ley correcta de una incorrecta. Vale la pena subrayar que la justicia racional (moral) es vital para crear una sociedad común buena. Esto muestra que la ley y la moral son relativas. El documento examina que la justicia moral es necesaria para el desarrollo de una persona. Para alcanzar el objetivo de este artículo, se analizó que ius cogens también se basa en valores morales.

The article deals with current general theory of law in respect of need of moral values. The emphasis is based on 8 arguments revealing why West culture’s general theory of law theory is rooted in moral values. There are analysed that moral values are obligatory in order to create general theory of law, because the individuals act morally in their daily life. Therefore, it distinguishes a correct judgment or law from an incorrect one. It is worth underlying that rational (moral) justice is vital to create common society good. This shows that law and moral are relative. The paper examines that moral justice is necessary for development of a person. To reach the goal of this article there were analysed that ius cogens is also based on moral values.
