El mecanismo europeo de estabilidad. Análisis a través de la jurisprudencia comunitaria en el asunto Pringle

Abstract

A raíz de la crisis financiera iniciada en el año 2007, la Unión Europea ha tenido que enfrentarse a uno de los principales desafíos desde su constitución. Las primeras reacciones ante la misma estuvieron marcadas por respuestas de carácter nacional, pero rápidamente se evidenció la necesidad de adoptar soluciones coordinadas, fundamentalmente entre los Estados de la Eurozona. Las exigencias de los mercados financieros internacionales obligaron a adoptar mecanismos provisionales, que han sido sustituidos por el Mecanismo Europeo de Estabilidad, de carácter permanente, para lo que fue necesaria la modificación del Tratado de Funcionamiento de la Unión Europea. Recientemente, el Tribunal de Justicia ha admitido la compatibilidad del proceso de reforma y del nuevo Mecanismo con los Tratados constitutivos. El primero de los programas que está siendo desarrollado por el recién creado mecanismo es la asistencia para la recapitalización del sistema financiero español.

Following the financial crisis in 2007, the E.U. has had to face major challenges since its inception. The first reactions to the crisis were marked by national responses, but quickly showed the need for coordinated solutions, primarily among the States of the Eurozone. The demands of international financial markets forced to adopt interim mechanisms, which have been replaced by the European Stability Mechanism, with permanent character, for which it was necessary to amend the Treaty on the Functioning of the European Union. Recently, the European Union Court of Justice has acknowledged the support of the reform process and the new mechanism with the founding Treaties. The first of the programs is being developed by the newly created mechanism is assistance to recapitalize the Spanish financial system.
