Abstract

O Contrato de transporte invoca interesse pela diversidade de elementos implicados na relação jurídica-contratual, desta forma, faz-se necessário, uma análise mais aprofundada de cada um dos seus elementos constitutivos com o claro objetivo de entender as vicissitudes que o afetam. Abordar os elementos constitutivos pessoais e elementos constitutivos formais, oferece-nos ferramentas importantes na construção dogmática da teoria geral desta modalidade contratual. O mesmo pode ser evidenciado como contrato de consumo e podemos salientar que a atividade transportista caracteriza-se como uma atividade essencial principalmente para o turismo, elemento de vital importância para o desenvolvimento econômico dos países do sul da Europa.
