Unión Europea y convenio europeo de derechos humanos: la cuestión abierta de la adhesión

Abstract

El reconocimiento y protección de los derechos fundamentales en la Unión Europea constituye una materia de relevancia singular en el proceso de integración europea, que se realza en una etapa de revisión de los Tratados como la actual. Los notables avances que ha introducido la Carta de los Derechos Fundamentales de la Unión Europea se han visto consolidados con su incorporación en el Proyecto de Tratado por el que se establece una Constitución para Europa, confirmándose la voluntad de sistematizar adecuadamente estos derechos. Sin embargo, las relaciones entre este modelo con el establecido en el Convenio Europeo de Derechos Humanos no ha sido aún convenientemente establecidas, quedando así sin resolver problemas actuales de potenciales conflictos entre el Tribunal de Justicia y el Tribunal Europeo de Derechos Humanos. El reconocimiento de una más amplia garantía sobre estos derechos y la atribución de una seguridad jurídica más amplia al ciudadano sobre el contenido de sus derechos fundamentales constituyen las claves de una posible y deseada adhesión de la Unión al Convenio del Consejo de Europa.

The recognition and protection of fundamental rights in the European Union is a greatly important subject in the european integration process, which is raised in a phase of revision of the Treaties like this. The remarkable progresses that the Charter of Fundamental Rights of the European Union has introduced, have been consolidated with the incorporation in the Treaty establishing a Constitution for Europe is established, affirming the intention of systematizing these rights suitably. However, the relations between this model and the one established in European Convention on Human Rights haven’t been established properly yet therefore some present problems of potential conflicts between the Court of Justice and the European Court of Human Rights are unsolved. The recognition of a wider guarantee on these rights and the attribution of a wider juridical security to citizens about the content of their fundamental rights are the keys for a possible and wished adhesion of the Union to the Council of Europe’s Convention.
