Abstract

Una de las grandes aportaciones que ofrece la Constitución Española de 1978 consiste en estructurar territorialmente el Estado de acuerdo con un modelo jurídico-constitucional relativamente nuevo y poco probado. Aún hay una pregunta pendiente y es cómo ha de calificarse entonces el reconocirniento del principio de autonomía de las nacionalidades y regiones. La respuesta es que al amparo del artículo 2 de la Constitución no son titulares de un poder público originario, sino derivado.

One of the great contributions offered by the Spanish Constitution of 1978 consists of territorially structuring the State in accordance with a relatively new and untried legal-constitutional model. There is still an open question as to how the recognition of the principle of autonomy of nationalities and regions is to be qualified. The answer is that under Article 2 of the Constitution they are not holders of an original public power, but a derived one.
