Transformaciones socio-económicas y su reflejo en el ordenamiento jurídico mercantil: del estado liberal al estado social

Abstract

Uno de los rasgos más característicos del ordenamiento jurídico es el de su relatividad histórica. Dentro de las diferentes ramas, el Derecho Mercantil es una disciplina jurídica en permanente proceso de transformación y evolución. Lo que hoy pertenece a su ámbito normativo es posible que no pertenezca mañana y no tiene por qué haberle pertenecido en el pasado. Ello significa que el estudioso del Derecho Mercantil ha de enfrentarse constantemente a la cuestión de qué debe ser en cada momento la disciplina objeto de su estudio. En otras palabras, es una materia progresiva­mente cambiante a lo largo de la historia. Pero el proceso de mayor cambio se produce desde la óptica del paso del Estado liberal al Estado social con la introducción de las constituciones económicas. Al análisis de los cambios operados en este periodo se dedica este trabajo.

One of the most characteristic features of the legal system is its historical relativity. Within the different branches, Commercial Law is a legal discipline in a permanent pro-cess of transformation and evolution. What belongs to its normative domain may not belong tomorrow and it does not have to have belonged in the past. This means that the Commercial Law student has to constantly face the question of what the subject goal of his study should be at all times. In other words, it is a progressively changing matter throughout history. But the process of greatest change occurred from the point of view of the transition from the liberal state to the social state with the introduction of economic constitutions. This paper is dedicated to the analysis of the changes that took place in this period.
