El arbitraje en el Derecho Romano como medio alternativo y adecuado de resolución de controversias

Abstract

Este artículo trata del arbitraje en el Derecho romano, especialmente de los arbitrajes compromisarios y de la Episcopalis audientia, para determinar sus rasgos esenciales, explicar su simbiótica relación con la jurisdicción, y plantearnos si el arbitraje llegó a ser en Roma un mecanismo alternativo y adecuado de resolución de controversias jurídicas.

This article deals with arbitration in Roman Law, specially, with the arbitration ex compromisso and the bishop audience (episcopalis audientia), in order to explain their essential features, their symbiotic relationship with iurisdiction and determine if arbitra-tion became in Rome an alternative and adecuate mechanism of dispute resolution
