La Orden Europea de Investigación en el delito de pornografía infantil

Abstract

La presente investigación analiza jurídicamente el potencial de la Orden Europea de Investigación para el procesamiento de los delitos de pornografía infantil contenidos en el artículo 189 del Código Penal. A tal fin, se ha realizado una revisión cualitativa de fuentes secundarias de información normativas, doctrinales y jurisprudenciales; para el mejor esclarecimiento del estado del arte. Mediante la misma se revelan las principales ventajas procesales de dicho instrumento de cooperación internacional, así como sus limitaciones y controversias respecto a la persecución del delito antedicho. En último lugar, se han expuesto las principales conclusiones del estudio junto a recomendaciones de eficacia cooperativa internacional en el ámbito de la pornografía infantil.

The present legal investigation analyzes the European Investigation Order potential in the prosecution of child pornography crimes under the article 189 of the Spanish Criminal Code. For this purpose and the better clarification of the state-of-the-art, I have conducted a qualitative literature review considering secondary sources of normative, doctrinal and case-law information. Through this method, I have exposed the main procedural advantages of this international cooperation instrument as well as its limitations and controversies regarding the prosecution of the aforementioned crime. Finally, I have listed the main conclusions of the study, besides some international cooperation effectiveness recommendations within the scope of child pornography crime.
