Cómo juzgan los adolescentes un caso real de maltrato entre iguales

Abstract

Este trabajo, parte de una investigación más amplia, recoge la perspectiva adolescente acerca de las medidas determinadas en el Juzgado de Menores ante un caso de maltrato entre iguales a través de una entrevista semiestructurada. Dada la especificidad de la materia y las modificaciones que recientemente ha sufrido, no se trata tanto de recoger la información que manejan los participantes, sino más bien indagar en la manera en que explican las decisiones que la justicia toma respecto al tratamiento que han de recibir quienes cometen esta infracción. En este sentido, la entrevista plantea al participante la tarea de determinar la actuación que considere oportuna a modo de juez intuitivo y explique por qué propone esa medida, qué espera conseguir y en qué se ha basado para decidir su propuesta. Se entrevistó a 72 adolescentes de tres grupos de edad (13-14, 15-16 y 17-18) pertenecientes a tres centros de Educación Secundaria de la comunidad de Madrid. La mitad de ellos ha cometido alguna infracción y se ha visto implicada en un proceso en el Juzgado, mientras que la otra mitad no ha vivido esta experiencia. La propuesta más frecuente en todos los grupos de edad es el internamiento. Cuando se distingue la modalidad de internamiento, se observa preferencia por los tipos que lo describen en términos formativos o combinando elementos formativos y restrictivos. Para justificar la actuación propuesta, los participantes sin experiencia tienden a exponer sus ideas acerca de las causas de la conducta, mientras que los que la tienen comentan los inconvenientes (costes, esfuerzo) que conlleva el cumplimiento de la medida. Ambos grupos persiguen con su propuesta una finalidad educativa, tanto modificación de la conducta como cambios cognitivos. Aunque éstos se buscan principalmente por adolescentes mayores sin experiencia.

This work, part of a broader research, gathers the adolescent perspective on the measures determined in the Juvenile Court in a case of peer abuse through a semi-structured interview. Given the specificity of the subject matter and the modifications it has recently undergone, it is not so much a matter of collecting the information handled by the participants, but rather of investigating the way in which they explain the decisions that the justice system makes regarding the treatment that those who commit this infraction should receive. In this sense, the interview presents the participant with the task of determining the action that he/she considers appropriate as an intuitive judge and explains why he/she is proposing that measure, what he/she hopes to achieve and on what basis he/she has decided on his/her proposal. A total of 72 adolescents from three age groups (13-14, 15-16 and 17-18) from three Secondary Education centers in the community of Madrid were interviewed. Half of them have committed an offence and have been involved in a court proceeding, while the other half have not had this experience. The most frequent proposal in all age groups is internment. When distinguishing the modality of internment, there is a preference for types that describe it in formative terms or by combining formative and restrictive elements. To justify the proposed action, inexperienced participants tend to present their ideas about the causes of the behavior, while those with experience comment on the disadvantages (costs, effort) involved in complying with the measure. Both groups pursue an educational purpose, both behavior modification and cognitive changes. Although these are mainly sought after by inexperienced older teenagers.
