La justiciabilidad del derecho a la vivienda en el ámbito internacional: el Comité Europeo de Derechos Sociales y su procedimiento de reclamaciones colectivas

Abstract

Este trabajo constituye un estudio sobre la justiciabilidad del derecho a la vivienda en el ámbito de la Carta Social Europea revisada, ratificada por España en mayo de 2021. En concreto, el estudio se centra en analizar el origen, el funcionamiento y la naturaleza del mecanismo de reclamaciones colectivas ante el Comité Europeo de Derechos Sociales, así como en desgranar la doctrina en materia de derecho a la vivienda que, por medio de este sistema, ha ido desarrollando el Comité.

This article examines the justiciability of the right to housing within the framework of the revised European Social Charter, ratified by Spain in May 2021. It specifically focuses on the origin, workings and nature of the mechanism for making collective complaints before the European Committee of Social Rights and on unpicking the doctrine on the right to housing developed by said Committee by means of this system.
