El asesinato múltiple castigado con prisión permanente revisable

Abstract

La importancia simbólica de la pena máxima y del principal delito castigado con ella se ha reforzado en dos sentidos en la reforma del CP español de 2015: se reintroduce la pena de prisión permanente revisable para el asesinato agravado, y como su forma hipercualificada se tipifica el asesinato múltiple en el art. 140.2 CP. Pero la oscura redacción de este precepto plantea diversos problemas interpretativos acerca de qué ha de entenderse por asesinato múltiple: cuántos deben reunirse, si algunos han de haber sido objeto de condena previa o no, qué se entiende por “muerte” y si la pena establecida es o no la conjunta para todos los asesinatos. A todos estos dilemas se intenta encontrar soluciones coherentes.

The symbolic importance of both the maximum penalty and the main crime punished with it have been reinforced in two ways in the 2015 reform of Spanish Penal Code: the reviewable permanent prison for aggravated murder is reintroduced, and serial murder, us its most aggravated form, is typified in art. 140.2 CP. But the unclear wording of this precept raises various interpretative problems concerning what is meant by serial murder: how many murders must be present, whether they must have been subject to prior conviction or not, what is meant by “death” and whether the penalty established is a combined one for all the murders. In this paper an attempt is made to find coherent solutions to these questions.
