La cooperación económica del Estado portugués con la Iglesia Católica

Abstract

El presente trabajo analiza la cooperación económica del Estado portugués con la Iglesia Católica, tras la entrada en vigor del Concordato de 18 de mayo de 2004, que sustituyó al Concordato de 7 de mayo de 1940 por no adaptarse éste ni a la realidad portuguesa, ni a la de la Iglesia. Con este Concordato las ayudas económicas se concedían a la Iglesia como indemnización por las expoliaciones y confiscaciones que sufrió en el pasado. Las actuales formas de cooperación se asimilan a las reguladas por la Ley 16/2001, de 22 de junio, de Libertad Religiosa para el resto de las confesiones religiosas radicadas en Portugal, en búsqueda de la igualdad, y su fundamento se encuentra en la función social, en relación con la libertad religiosa, que cumple la Iglesia Católica y sus entes.

The paper analyzes the economic cooperation of the Portuguese State with the Catholic Church with the Concordat of May 18, 2004, which replaced the Concordat of May 7, 1940, for not adapting either to the Portuguese reality or to that of the Church. In this Concordat the financial aid was granted to the Church as compensation for the spoliations and confiscations suffered in the past. The current economic cooperation is similar to that regulated by Law 16/2001, of June 22, on Religious Freedom for the rest of the religious confessions based in Portugal, in search of equality. And its foundation lies in the social function, in relation to religious freedom, that the Catholic Church and its entities fulfill.
