La transmisión de la propiedad en el contrato de compraventa en el Código Civil portugués

Abstract

El contrato de compraventa aparece regulado en el Código Civil portugués de 1966, en el Capítulo I "Compraventa" (artículos 874 a 939), dentro del título II ("De los contratos en especial"), Libro IV (Derecho de las obligaciones). Según lo dispuesto en este articulado, podemos definir la compraventa como el contrato por el cual se transmite la propiedad de una cosa, y otro derecho, a cambio de un precio. De esta definición ya se infieren cuáles serán las características esenciales de su naturaleza: real y obligacional.

The contract of sale is regulated in the Portuguese Civil Code of 1966, in the Chapter I "Sale" (articles 874 to 939), within the title II ( "Of the contracts in particular" ), Book IV (Law of Obligations). In accordance with the provisions of this articulated, we can define the sale as the contract by transmitting the property of a thing, and another right, in exchange for a price. This definition was already infered what will be the essential features of his nature: real and obligations.
