Resumen: Una protección eficaz del consumidor en el ámbito del comercio electrónico debe trascender las propias fronteras de cada país. Y toda nueva actividad económica necesita una regulación legal. En el mercado siempre existe la inclinación de una de las partes de obtener ventajas. La ley debe regular la nueva situación que se crea y proteger a la parte más débil, como son los consumidores. El comercio electrónico se configura, asimismo, como una actividad global. La intervención de diferentes partes contractuales pertenecientes a distintos países puede plantear problemas en la resolución de conflictos, principalmente en orden a determinar la ley y jurisdicción nacionales aplicables.
An effective consumer protection in electronic commerce must go beyond the borders of each country's own. The existing law has to apply to itas best it can. On fluctuating markets, there is always the temptations for one of the parties later to try to get out of it if the market has moved against him or her. The simplest argument is that not valid contract has been made in the first place. It is therefore necessary to decide when there is a binding contract in principie and, if so, the effect of a qualification such a subject details, as consumers. Ecommerce is a global activity and it is quite likely that the contracting parties will be in different countries. Obviously, this can lead to potential for disputes about which country ' s law applies, and also as to jurisdiction over the defendant.
