Resumen: En el presente artículo trataremos de abordar un tema de notable complejidad y con múltiples facetas como es la asistencia médica a los menores. Para ello debemos partir del hecho de que, desde el punto de vista legal, los menores son sujetos de derechos a los que progresivamente se les dota de capacidad para poder ejercer esos derechos. Por tanto, no podemos considerar a los menores como si se tratasen de personas incapacitadas legalmente. Es cierto que precisan protección, y que se trata de ajustar las dos condiciones que concurren en estos sujetos: por un lado su condición de sujeto de derechos, con capacidad para ejercerlos y de otra, su condición de sujeto dependiente de sus representantes legales, por el cual en determinados momentos precisan de complementar dicha capacidad para que sus actos sean apropiados. Cualquier actividad médica se centra básicamente en la relación médico-paciente, donde ambos se necesitan mutuamente. Pero esta relación se complica considerablemente en el mundo de la medicina pediátrica, donde el paciente que atender es un menor. En estos casos, entran en juego consideraciones muy variadas, tanto legales y éticas como deontológicas, que plantean dudas acerca de si lo que estamos haciendo lo estamos haciendo bien o, por el contrario, se podría hacer de otra manera, pero que en definitiva obligan al médico a adoptar decisiones en referencia a la asistencia, al menos.
In this article we will try to address an issue of considerable complexity and multiple facets, such as the medical care to minors. To do this we must start from the fact that, from the legal point of view, children are subjects of rights, and they are progressively provided with capacity to exercise those rights. Therefore we cannot consider children as if they were legally incapacitated persons. They need protection, and two conditions concur in them, first the condition of being the subjects of rights they are able to exercise and second their condition of being dependent subjects of their legal representatives, by which at certain times they need to supplement this capacity, so that their actions are appropriate. Any medical activity basically focuses on the relationship between doctor and patient, where both need each other. But this relationship is considerably complicated by the world of paediatric medicine where the patient is a minor. In these cases, very different considerations, both legal and deontological raise doubts about whether what I'm doing is right or it could be done otherwise, but ultimately it forces the doctor to make decisions with reference at least to the attendance.
