Resumen: Objetivo: En este trabajo se quiere ofrecer la oportunidad de reflexionar y debatir sobre las nuevas formas de malestar psicológico asociado al uso inadecuado de las nuevas tecnologías y los posibles métodos de intervención. También tiene como objetivo proporcionar un conocimiento profundo sobre el uso y abuso de las nuevas tecnologías digitales, los fenómenos relacionados de la desviación a la intimidación/acoso cibernético, la gestión de conflictos, la situación jurídica del niño, la responsabilidad de la misma y el papel de diversos organismos educativos en relación con estos fenómenos. Será de interés para todos aquellos que tienen relaciones con menores de edad en la educación, la atención educativa, social y de salud, psicológicos, legales, de investigación y forense. El ámbito de trabajo es proporcionar instrumentos adecuados para garantizar que cada profesional, también en sinergia con otros operadores, pueden lograr acciones apropiadas para prevenir y gestionar situaciones de delincuencia juvenil, relacionados con el uso de nuevas tecnologías, así como proteger y garantizar los derechos aspectos de desarrollo, sociales y legales del niño en todos los contextos en los que la misma se encuentran a vivir. Método: La tesis tiene como objetivo hacer un balance de la armonización internacional de normas en los distintos Estados para prevenir los actos de acoso cibernético y sexting. Resultados: El resultado de este trabajo se identifican dos hechos principales: 1) El fenómeno de la cyberbillismo y sexting están aumentando en todo el mundo; 2) Las regulaciones de los estados individuales son insuficientes e inadecuados para hacer frente a la fenómeno. Conclusiones: El ciberacoso es un verdadero crimen en algunos países, mientras que en muchos otros el ajuste del fenómeno sigue siendo incierto y en desarrollo. Lo que usted tiene la intención de demostrar con este trabajo es la necesidad de adoptar medidas para prevenir y combatir el fenómeno, que está coordinado en varios frentes: en primer lugar, es deseable, por los estados y nivel supranacional, la adopción de normas legales que favorecen ajuste del fenómeno y la protección de las víctimas. En segundo lugar, a partir de estas disposiciones, es esencial que los proveedores de servicios de Internet a que adopten códigos que les facilitan en situaciones de riesgo. En este sentido, hay que entender lo que las estrategias de autorregulación (adoptado y adoptables) que mantienen la libertad de expresión original en la web. En tercer lugar, hay que tener en cuenta que los jóvenes usuarios de Internet continuamente crean redes interactivas lejos de supervisión de un adulto. De hecho, la Web es la herramienta perfecta para el agresor, que pueden llegar a su víctima en cualquier momento y en cualquier lugar, incluso de forma anónima. Esto significa que para muchos niños, la casa ya no es un refugio frente a la intimidación sufrida en la escuela. The present work aims to provide an opportunity to reflect on and confront the new forms of psychological discomfort associated with the improper use of new technologies and possible intervention methodologies. It also aims to provide an in-depth knowledge of the use and abuse of new digital technologies, the phenomenon of deviance related to bullying / cyberbullying, conflict management, legal status of the child, responsibilities of the child And the role of the various educational agencies in relation to the aforementioned phenomena. It is aimed at all those who relate to children in educational, pedagogical, socio-health, psychological, legal, investigative and criminological fields. The purpose of the work is to provide appropriate tools for each professional, even in synergy with other operators, to carry out appropriate actions to prevent and manage situations of youth deviance related to the use of new technologies and to protect and secure the rights Evolutionary, social and legal rights of children in every context in which they live. Method: The paper intends to address the international level of norms in individual states to prevent cyber bullying and sexting. Results: The result of this paper identifies two main facts: 1) The cyberbillistic and sexting phenomena are constantly increasing throughout the world; 2) The laws of individual states are insufficient and inadequate to deal with the phenomenon. Conclusions: Cyberbullying is a real offense in some countries, while in many others the regulation of the phenomenon remains uncertain and developing. What is meant to demonstrate with this work is the need for intervention to prevent and counteract the phenomenon, which is coordinated on several fronts: first, it is desirable, on the part of the states and at the supranational level, to adopt legal rules that favor the Regulation of the phenomenon and protection of the victims. Secondly, from these provisions, it is imperative that Internet Service Providers adopt codes that facilitate them in managing risky situations. In this regard, one must understand the self-regulatory strategies (adopted and adopted) that keep the original freedom of expression of thought on the web. Third, the fact that young internet users are constantly creating interactive networks away from adult supervision should be kept in mind. In fact, the web is the perfect tool for bully, which can reach its victim always and everywhere, even anonymously. This means that for many children, the home is no longer a shelter from school bullying. So it is about acting on two other levels, as well as on the national / supranational and the providers: first of all the family, whose task is to educate their children about the correct use of the network and, consequently, that of the school that must To carry out prevention and support activities, providing the children with the tools they need and the skills they need to stem the phenomenon and to be legally protected, without overcoming bullying and becoming bullies in turn.
