Problemas jurilingüísticos en la traducción de los nombres de órganos de justicia entre polaco y español

Abstract

El objetivo del presente artículo es proponer una traducción eficaz de los nombres de órganos de justicia polacos al español y los españoles al polaco. Como observan los autores, por falta de literatura especializada sobre el tema así como univocidad entre las pocas fuentes que existen, los traductores tienen muchos problemas a la hora de traducir documentos judiciales. De ahí que deciden solucionar esa cuestión basándose en los criterios tanto lingüísticos como legales. Dado que la traducción de este tipo exige conocimientos interdisciplinares, al principio del texto caracterizan de manera breve los dos sistemas de justicia. Por consiguiente, enumeran los criterios de equivalencia en la traducción de nombres oficiales, para llegar a un análisis de las propuestas ya existentes, a base de las cuales proponen una solución que toma en cuenta aspectos tanto filológicos como jurídicos.

The aim of this article is to propose an effective translation of the names of Polish justice organs into Spanish and Spanish into Polish. As the authors note, because of lack of literature on the subject and the accordance among the few sources that exist, the translators have many problems with translating of the official documents. Hence, they decide to solve this issue on the basis of both linguistic and legal criteria. Since such translation requires interdisciplinary knowledge, at the beginning of the text, they briefly characterize the two systems of justice. Next, they present the equivalence criteria for the official name translation and intend to analyze the existing propositions, based on which give a solution that takes into account both philological and legal aspects.
