Abstract

El presente trabajo trata de ser nuestra modesta contribución al deslinde de la relación laboral, que se encuentra encuadrada en el ámbito de aplicación del Estatuto de los Trabajadores, con aquellas otras figuras jurídicas que, si bien guardan similitudes en cuanto a sus notas configuradoras, se hallan excluidas del campo de aplicación del Derecho del Trabajo. La relación contractual de los becarios es una de esas figuras con las que el contrato de trabajo guarda notables afinidades; y es, pues, dificil la delimitación y establecimiento de fronteras entre ambas.

This paper is our modest contribution to the demarcation of the employment relationship, which falls within the scope of application of the Workers' Statute, from those other legal concepts which, although they have similarities in terms of their characteristics, are excluded from the field of application of Labour Law. The contractual relationship of scholarship holders is one of those legal concepts with which the employment contract has notable affinities; and it is therefore difficult to delimit and establish boundaries between the two.
