La protección de las creaciones de la inteligencia

Abstract

En el presente trabajo se aborda la necesidad de proteger las creaciones de la inteligencia, que se manifiesta, de un lado, en la tutela de la propiedad industrial y, de otro, en la defensa de los derechos de autor. Como cuestión previa a una respuesta rigurosa sobre los modos de protección, se impone la necesidad de analizar la naturaleza jurídica de estas dos clases de propiedades especiales. Con la propiedad industrial se trata de proteger las creaciones del intelecto humano encaminadas a fomentar el progreso técnico, que redundan en el bienestar social de un país. Los derechos de autor tienen por objeto la protección de las creaciones estéticas, científicas o musicales que sirven para satisfacer necesidades ideales de la humanidad. Se analiza, por último, el plagio como la principal infracción de los derechos de autor.

This paper addresses the need to protect the creations of intelligence, which manifests itself, on the one hand, in the protection of industrial property and, on the other, in the defense of copyright. As a question prior to a rigorous response on the modes of protection, it is necessary to analyze the legal nature of these two classes of special properties. With industrial property, it is about protecting the creations of the human intellect aimed at promoting technical progress, which result in the social welfare of a country. Copyright is intended to protect aesthetic, scientific or musical creations that serve the ideal needs of humanity. Lastly, plagiarism is analyzed as the main copyright infringement.
