Los Derechos Humanos desde la perspectiva de Thomas Paine

Abstract

A partir del tránsito a la Modernidad, nos encontramos con el concepto de Derechos Humanos, en los inicios del Estado Liberal donde aparecen las primeras Declaraciones de Derechos, que podríamos encuadrar en tres modelos distintos, el modelo inglés, el modelo americano y el modelo francés. Es en el modelo americano, donde encontramos la figura de Thomas Paine, autor prácticamente desconocido en nuestro país y al cual se pretende dedicar la presente investigación al considerarlo pieza clave en la evolución histórica de los Derechos Humanos, puesto que sus obras estarán presentes en las dos Revoluciones que dan paso al Estado Moderno y aunque incardinado cronológicamente en el modelo liberal anticipa el concepto de algunos derechos propios del Estado del Bienestar o incluso de nuevos derechos que emergen en el siglo XXI. Su panfleto denominado Common Sense supuso un punto de inflexión ya que en él se contienen las bases del pensamiento de Paine que mantendrá a lo largo de su obra. Las otras obras que serán examinadas son Rights of Man, Dissertation on First Principles of Government, Age Of Reason y Agrarian Justice Se trata del primer escritor político moderno que se expresó en la lengua del ciudadano corriente, dándole los argumentos necesarios para participar en el debate político de la época y defender sus derechos dentro de un sistema democrático. Finalmente, será abordada la situación actual de los Derechos Humanos, su evolución y regulación desde 1948 a nivel internacional y las consecuencias de la globalización, con la aparición de nuevas necesidades y actores y cómo el legado de Paine sigue totalmente vigente en este proceso progresivo e inacabado que es siempre la lucha por la defensa de los Derechos Humanos.

The concept of Human Rights can be found in the beginning of what has been called “Modern Times”, in the very beginning of the Liberal State where the first Declarations of Rights could be found and classified in three different models: English, American and French. It is in the American model where the figure of Thomas Paine is placed: an almost unknown author in our country to whom this research is going to be dedicated, as we consider him a key player in the historical evolution of Human Rights because of the importance of his writings in the two Revolution that gave birth to the Modern State and despite he belongs to the Liberal Model he anticipates the concept of certain rights of the Welfare State and even new rights that emerge in the 21st century. Common Sense became a turning point because it contains the principle ideas of Paine´s thought. The other writings by Paine that are going to be analyzed are The Rights of Man, Dissertation on First Principles of Government, Age Of Reason and Agrarian Justice. He was the first modern political writer who expressed himself in a colloquial way and for this reason his writings reached thousands of ordinary people, giving them the necessary arguments to participate in the political debate of the times and to defend their rights inside a democratic system. Finally the present situation of Human Rights will be analyzed, its international evolution and regulation from 1948, the consequences of the globalization that give birth to new needs and actors and how Paine´s legacy remains valid in this progressive and unfinished process that the fight for the defense of human rights is.
