Abstract: | Compartir vehículo con el objetivo de minimizar los gastos propios de
cualquier viaje es una práctica frecuente, tal y como demuestran las cifras de las
principales plataformas que operan en este ámbito, y, por qué no decirlo, un reto para el
legislador tributario al decidir si someter a gravamen al prestador del servicio.
Las reflexiones sobre los principios de generalidad, capacidad económica, seguridad
jurídica o los beneficios fiscales, presentes en determinadas figuras impositivas,
enmarcan el análisis en torno a los retos que plantea el fenómeno del transporte
colaborativo en la actualidad.
Hechas las consideraciones anteriores, nuestro objetivo es estudiar los principales
problemas que esta modalidad de economía colaborativa presenta en materia tributaria
desde la perspectiva de los principios anunciados, analizar las diferentes propuestas que
se han formulado y proponer otras nuevas. Todo ello, como consecuencia de la principal
conclusión a la que se llega tras el estudio de esta materia: la necesidad de una
regulación que arroje luz sobre la fiscalidad de la economía colaborativa, y más
concretamente, del transporte colaborativo. Sharing a ride with the objective of minimizing the expenses of longdistance commutes is a common practice, as shown by the figures of the main carpooling platforms, and, why not, a challenge for the tax legislator when considering whether or not to apply a tax to the service provider. Some principles including generality, economic capacity, legal security or the fiscal benefits, present in certain tax figures, enclose the reflections on the challenges posed by the phenomenon of carpooling transport today. The objective for this essay is studying the main problems that these chargeable sharing earnings raise from the point of view of the principles mentioned before, as well as analyzing different proposed approaches and other new ones. All of this as a consequence of the main conclusion reached after the study of this subject: the need for a regulation that sheds some light on the taxation of the sharing earnings, specifically, carpool platforms. |
