La categoría jurídica "sujeto/objeto" y su insuficiencia respecto de los animales. Especial referencia a los animales usados en laboratorios

Abstract

Las relaciones entre la persona humana y los demás integrantes del reino animal han variado a lo largo de la historia y estas vicisitudes también se han hecho visibles en el Derecho. Mientras los códigos civiles tradicionales ubicaban a los animales entre las «cosas» excluyéndolos de cualquier consideración como sujetos de derecho, la evolución actual de la Ciencia y el desarrollo de la ética moderna han llevado, por el contrario, a sostener la necesidad de su protección jurídica. En este marco, las regulaciones sobre uso de animales en los laboratorios de experimentación han propiciado un profuso debate sobre los alcances de dicha tutela. De acuerdo con algunos activistas y defensores de animales, ningún animal en ninguna circunstancia, debe ser sometido a un experimento en un laboratorio. Otros activistas, por su parte, pretenden que se evite todo sufrimiento pero sin resistirse al desarrollo de estas prácticas en tanto sean cuidadas celosamente. En el otro extremo están los que se oponen a toda protección de los animales en este ámbito. Frente a estas situaciones, el presente trabajo ofrece un análisis de la cuestión y concluye con aquellos contenidos mínimos indispensables en la elaboración de una ley compatible con el bienestar del animal.

The relationships between human beings and other members of the animal kingdom have varied throughout time and said ups and downs have also become evident within the field of Law. While traditional Civil Codes placed animals among «things», considering them as not being entitled to any right, the current evolution of Science and the development of modern Ethics hold, on the contrary, that animals shall be legally protected. Within this frame, regulations about the use of animals in laboratory experimentations have given rise to a profuse debate about the scope of said protection. According to defenders of animals’ rights, no animal shall be subjected to any kind of laboratory experimentation under no circumstance. Meanwhile other defenders try to avoid animals suffering without rejecting the development of said practices; provided that these experimentations are carried out carefully and conscientiously. On the other side, it is possible to find people who oppose to animals’ protection within this field. Facing these polemic situations, this report offers a deep analysis and a conclusion about those bare essential contents required in the elaboration of a law compatible with animals’ well-being.
