La asignatura de Educación para la Ciudadanía y su implantación en la enseñanza española

Abstract

Este artículo trata de describir el régimen jurídico de una nueva asignatura denominada «Educación para la Ciudadanía». Esta asignatura ha sido introducida por la nueva Ley Orgánica de Educación y su implantación ha dado lugar a un profundo debate en España, fundamentalmente, por la posibilidad de que estas asignaturas puedan poner en peligro la pervivencia de la enseñanza de la religión en los centros escolares. Muchas familias han llegado incluso a plantear la objeción de conciencia a recibir estas enseñanzas. Nuestra intención es describir los problemas más importantes de Educación para la Ciudadanía y la manera en la que han sido resueltos por los tribunales de justicia. Para ello, se realiza recorrido tanto por la jurisprudencia del Tribunal Supremo, como por la de los Tribunales Superiores de Justicia que han propiciado los pronunciamientos más significativos en esta materia.

This article attempts to describe the legal regime of a new discipline named «Education for Citizenship». This discipline has been introduced by the Education Act, and its introduction has been caused a big debate, because many people think that these disciplines can be dangerous for the survival of religious educations in the schools. A lot of families have managed to raise the objection of conscience to receiving these educations. Our intention is to describe the most important problems of «Education for Citizenship» and the way in which they have been solved by the courts of justice. For it, is important to realise a journey through the jurisprudence of the High Court, as well as through the Superior Justice Courts that caused the most significant pronouncements to this matter.
