Abstract: | El esquema normativo español de los siglos XVI y XVII se caracteriza por el fortalecimiento del poder real, en ascenso desde la Baja Edad Media, traduciendo una manifiesta centralidad, que culminará en expresiones absolutistas durante el siglo XVIII. Esta mentalidad influirá en el tratamiento de la protección domiciliaria en normas dispersas de carácter penal, aunque con una nota característica interesante cual es la protección, casi exclusiva, de las moradas pertenecientes a las clases más altas de la sociedad. The spanish legislative framework in 16th and 17th centuries is characterized by the strengthening of the royal power, that was constantly growing up since the Early Middle Ages. It means a clear centrality which will end up in absolutist displays all over the 18th century. This mentality will influence in the processing of the domiciliary protection in disperse legal parameters of penal nature. However with an interesting remark.
