Elogio de la desheredación

Abstract

La realidad de los Despachos notariales prueba que el sistema legitimario establecido por el Código civil recibe un respaldo amplísimo de los testadores, superior incluso al 90%. Eso significa –a juicio del autor– que no tiene sentido establecer un sistema de absoluta libertad de testar, sino que sólo hay que dar cauce a ese pequeño porcentaje que entra en colisión con el actual sistema legitimario. Es decir: manteniendo nuestro sistema legitimario, hay que «darle aire y oxígeno» para que pueda acoger a los testadores que chocan con él. Y en esa tarea de dar aire a las legítimas, el autor entiende que la desheredación es la pieza fundamental, con la única condición de que no sea interpretada restrictivamente.

The real every day work at the public notary studies shows that the restrictions to testators enforced by the Civil Code (in Spain called «legítimas»), are agreed with the wishes of a large majority of clients (even more 90%). It means –in my opinion– that a system of «testamentary complete freedom» is just not necessary. Otherwise, would be enough to receive in the actual system this few people that crash with the actual restrictions to make last will and testament. I say: the actual system is a good system which only needs «fresh air and oxygen» to receive this few people that, actually, disagree with the restrictions. How? The author thinks that «disinherit» is the basic piece, with a simple warning: never make restrictive interpretations.
