El control jurisdiccional de constitucionalidad. La experiencia estadounidense como paradigma del activismo judicial

Abstract

Este artículo pretende abordar el ya clásico debate en torno a la legitimidad de la justicia constitucional y de la propia constitución como norma suprema del ordenamiento jurídico, garante de un núcleo indisponible de derechos y libertades. A tal fin, se llevará a cabo un sucinto análisis de la evolución histórica de la justicia constitucional estadounidense para intentar perfilar la imperiosa actualización del marco jurídico-constitucional norteamericano, renovación que se ha convertido, con el devenir del tiempo, en una exigencia real y palpable que ha de analizarse desde la óptica del Derecho comparado.

This article intends to treat the «classic» debate around the legitimacy of constitutional justice and of the Constitution itself as the supreme law of the legal system as guarantee of the bare essentials of rights and freedoms. For that purpose, a brief analysis of the historical evolution of American constitutional justice will be carried out, in an attempt to outline the urgent need to update the American legal-constitutional framework, a restructure that has become, with the passage of time, in a clear necessity that should be analyzed from a compared law viewpoint.
