La filosofía jurídica hermenéutica en España

Abstract

La Filosofía jurídica hermenéutica constituye una manera de pensar lo jurídico que trasciende el aspecto meramente metodológico. Frente a las posturas que ven la hermenéutica jurídica como un proceso técnico-instrumental, en relación con el momento de aplicación del Derecho, su pretensión es comprender el Derecho desde una perspectiva filosófica, partiendo desde la ontología jurídica, mediante una reflexión profundamente integral. En este trabajo se hace un breve recorrido por la Hermenéutica iusfilosófica española desde sus orígenes hasta la actualidad, examinando en qué medida se ha ido articulando un pensamiento hermenéutico-jurídico en nuestra Filosofía jurídica.

Hermeneutical legal Philosophy constitutes a way of thinking about the Law that transcends the merely methodological aspect. Faced with the positions that see legal hermeneutics as a technical-instrumental process, in relation to the moment of application of the Law, its claim is to understand the Law from a philosophical perspective, starting from the legal ontology, through a deeply integral reflection. In this work, a brief tour of the Spanish Philosophical-Legal Hermeneutics is made from its origins to the present, examining the extent to which a hermeneutic-legal thought has been articulated in our Legal Philosophy.
