La acción de nulidad de testamento. Concepto y ejercicio

Abstract

La nulidad es un defecto estructural del negocio, porque deriva de una irregularidad en su formación (defectuoso, viciado o imperfecto). Es también una ineficacia radical o automática en el sentido de que se produce ipso iure y sin necesidad de que se ejercite ninguna acción por parte de los interesados, incluso el juez puede declarar de oficio la nulidad. El negocio nulo nace inatendible y nadie debe prestar amparo a las pretensiones fundadas en él.

Invalidity is a structural defect of the business, because it derives from an irregularity in its formation (defective, flawed or imperfect). It is also a radical or automatic ineffectiveness in the sense that it occurs ipso jure and without the need for any action to be taken by the interested parties, even the judge can declare nullity ex officio. The null business is born unattainable and no one should provide protection for the claims based on it.
