Consideraciones históricas sobre el derecho de sufragio en España

Abstract

Resulta cada vez más frecuente considerar, sobre todo a nivel de investigación, las normas y las instituciones del pasado bajo un sentido utilitarista o pragmático, a fin de destacar, hayan o no dejado de regir, en qué forma han marcado nuestro devenir histórico o acaso han condicionado nuestro presente, de manera que pueda quedar de manifiesto la relación, el hilo conductor, entre hechos y soluciones del pasado y situaciones de la actualidad. Una institución, la del sufragio y cuanto concierne a su concepción, reconocimiento y ejercicio, permitirá mostrar esa trayectoria que siempre existe, en este caso particularmente sinuosa y difícil como corresponde a la época en que tiene lugar, y las repercusiones de los acontecimientos políticos y de otra índole que tienen en dicha institución su reflejo, al poner de manifiesto la íntima relación entre el Derecho y la Sociedad.

It is increasingly common to consider, especially at the research level, the norms and institutions of the past in a utilitarian or pragmatic sense, in order to highlight, whether or not they have ceased to govern, in what way they have marked our historical evolution or perhaps They have conditioned our present in such a way that the relationship, the common thread, between events and solutions of the past and current situations can be revealed. An institution, that of suffrage and what concerns its conception, recognition and exercise, will allow to show that trajectory that always exists, in this case particularly sinuous and difficult as corresponds to the time in which it takes place, and the repercussions of political events and of another nature that have their reflection in said institution, by highlighting the intimate relationship between Law and Society.
