La Declaración Universal de Derechos Humanos. Naturaleza jurídica y aplicación por los órganos jurisdicionales internos

Abstract

La pauta hermenéutica contenida en el art. 10,2 de la Constitución española conforme a la cual "Las normas relativas a los derechos fundamentales y a las libertades que la Constitución reconoce se interpretarán de conformidad con la Declaración Universal de Derechos Humanos y los tratados y acuerdos internacionales sobre las mismas materias ratificados por España", constituye un excelente motivo de reflexión acerca de la naturaleza jurídica de la Declaración Universal de Derechos Humanos y de su aplicación por algunas jurisdicciones internas.

The hermeneutic guideline contained in Art. 10.2 of the Spanish Constitution, according to which "The norms relating to the fundamental rights and freedoms recognised by the Constitution shall be interpreted in accordance with the Universal Declaration of Human Rights and the international treaties and agreements on the same subjects ratified by Spain", constitutes an excellent reason for reflection on the legal nature of the Universal Declaration of Human Rights and its application by some domestic jurisdictions.
