Comentario de la Sentencia del Tribunal Supremo de 22 de febrero de 1997 (Resolución de Aranzadi nº 120/1997)

Abstract

Estudio de la Sentencia del Tribunal Supremo de 22 de febrero de 1997 , en el que destaca las posturas que adopta el Tribunal Supremo, con gran nitidez, sobre cuestiones controvertidas como: la posibilidad de prescindir del contador-partidor cuando existe acuerdo unánime entre los coherederos y que el legatario de parte alícuota es parte necesaria para la elaboración del cuaderno particional. Tanto esta sentencia, como la de 20 de octubre de 1992 se han convertido en resoluciones de obligada consulta toda vez que se pretenda profundizar en un análisis riguroso de los temas de partición hereditaria.

Study of the Supreme Court Judgement of 22 February 1997, in which it highlights the positions adopted by the Supreme Court, with great clarity, on controversial issues such as: the possibility of dispensing with the accountant-partidor when there is unanimous agreement among the co-heirs and that the legatee of an aliquot part is a necessary party for the preparation of the partitional notebook. Both this judgement and that of 20 October 1992 of 20 October 1992 have become rulings that must be consulted whenever the aim is to go into whenever a rigorous analysis of the issues of inheritance partition is to be carried out.
