Subsidiariedad y Constitución

Abstract

El presente trabajo analiza el principio de subsidiaridad, término que ha adquirido recientemente en el léxico político y jurídico, su valor específico de significado. El citado principio se ha convertido en una idea fuerte del Constitucionalismo contemporáneo. De aquel Constitucionalismo, que está fortaleciendo sus sólidas raíces a través de la experiencia político-institucional- económica europea, que indica este final de siglo y que se abre al próximo. Las Constituciones y los Constitucionalismos de los Estados adheridos a la Unión Europea no pueden caminar separadamente por el recorrido europeo, más bien deben necesariamente adecuarse a éste. Así es para el principio de subsidiariedad, que ha encontrado su pleno reconocimiento normativo a nivel comunitario -en aquella que se suele llamar Constitución europea- y que en cambio a duras penas se encuentra a nivel nacional.

This paper analyses the principle of subsidiarity, a term that has recently acquired its specific meaning in the political and legal lexicon. The aforementioned principle has become a strong idea of contemporary Constitutionalism. Of that Constitutionalism, which is strengthening its solid roots through the European political-institutional-economic experience, which indicates this end of the century and which opens up the next one. The Constitutions and Constitutionalisms of the States adhering to the European Union cannot walk separately along the European path, but must necessarily adapt to it. This is the case for the principle of subsidiarity, which has found its full normative recognition at the Community level - in what is usually called the European Constitution - and which, on the other hand, is hardly to be found at the national level.
