Abstract: El Derecho penal se caracteriza formalmente por ser un conjunto de normas jurídicas, por lo que importa saber qué naturaleza han de poseer esas normas y qué estructura encierran. Este aspecto formal de la norma es del que trataremos en estas líneas. Las normas penales no son puros mandatos coactivos, sino exigencias ajustadas al orden colectivo, que apelan a la comprensión por sus destinatarios de su significado racional y reclaman, en ese sentido, su acatamiento civilizado. Sentado que el Ordenamiento jurídico busca crear, mediante las normas, un orden valioso de la vida social, la realización antijuridica del tipo es una conducta que menoscaba este orden valioso.
Criminal law is formally characterized as a set of legal rules, so it is important to know what nature these rules must have and what structure they contain. It is this formal aspect of the rule that will be dealt with in these lines. Criminal rules are not purely coercive coercive mandates, but rather requirements adjusted to the collective order, which appeal to their addressees' understanding of their rational meaning and demand, in this sense, their civilized compliance. Since the legal system seeks to create, by means of rules, a valuable order of social life, the unlawful realization of the type is a conduct that undermines this valuable order.
