Nuevo enfoque de la responsabilidad médico-sanitaria: la perspectiva de la defensa de los consumidores y usuarios

Abstract

Uno de los temas más estudiados en el Derecho civil es el de la responsabilidad médica, sanitaria o médico-sanitaria. Numerosas sentencia del Tribunal Supremo se refieren a ella y también la doctrina le ha dedicado muchísima atención en los últimos tiempos, por lo que resulta casi imposible añadir alguna idea a las que ya se han publicado. Sin embargo, existe un camino poco explorado hasta el momentoy al que dedicaremos estas páginas, consistente en enfocar la responsabilidad sanitaria desde un prisma distinto, el de la Ley General de Defensa de los Consumidores y Usuarios.

One of the most studied topics in civil law is that of medical, sanitary or medical-health liability. Numerous rulings of the Supreme Court refer to it and the doctrine has also devoted a great deal of attention to it in recent times, making it almost impossible to add any ideas to those that have already been published. However, there is a path that has been little explored up to now and to which we will devote these pages, consisting of approaching health liability from a different prism, that of the General Law for the Defense of Consumers and Users.
