La protección registral del tercer adquirente de un heredero voluntario: un supuesto de excepción a la fe pública registral

Abstract

La protección registral se fundamenta en la presunción de exactitud e integridad del Registro, la cual reviste carácter iuris et de iure cuando entra en escena el llamado tercero hipotecario. Desde esta perspectiva el principio de fe pública registral se erige en la máxima garantía del tráfico juridico inmobiliario.

Registration protection is based on the presumption of accuracy and integrity of the Register, which takes on a de jure and de facto character when the so-called third party mortgagee enters the scene, and from this perspective the principle of public faith in the Register is the maximum guarantee of legal real estate transactions.
