La ordenación urbanística: Función social. La clasificación y calificación del suelo

Abstract

El planteamiento del tema ha de hacerse desde la perspectiva constitucional, destacando, en especial, el régimen jurídico al que se somete el derecho de propiedad urbana, justificado por la función social a que toda propiedad está sujeta en un Estado social de Derecho. En este punto, rozando la reserva de ley y el contenido esencial de este derecho fundamental, aunque de doble vinculación, plantearemos, de una parte, la incidencia del Planeamiento, norma administrativa, en este derecho de propiedad, y, de otra parte, las facultades, potestades o deberes, que el propietario del suelo tiene y que ha de ejercer para cumplir con su función social.

The issue has to be approached from a constitutional perspective, in particular, the legal regime to which the right to urban property is subject, justified by the social function to which all property is subject in a social state under the rule of law in a social state governed by the rule of law. On this point, bordering on the reservation of the law and the essential content of this fundamental right, albeit with a double connection, we will consider, on the one hand, the incidence of Planning, an administrative rule, on this right to property, and on the other hand, the faculties, powers or duties that the owner of the land has and which he must exercise in order to fulfil its social function.
