Documento: “Cese la práctica de motivar las sentencias". Real Cédula de Carlos III de 1768

Abstract

Durante una parte de los siglos XVIII y XIX, y en contra de nuestra tradición, las sentencias no se motivaron porque se encontraba prohibido el hacerlo. La Real Cédula de Carlos III, prohibió motivar las sentencias, en consideración a que daban lugar a “cavilaciones de los litigantes”, consumían “mucho tiempo en la extensión de las sentencias” y acrecentaban con ello las costas de las partes. La recuperación del deber de motivar las sentencias se materializa, primero, en el Código de Comercio de 1829 y luego, en la Ley de Enjuiciamiento Civil de 1855.

During part of the 18th and 19th centuries, and contrary to our tradition, sentences were not reasoned because it was forbidden to do so. The Royal Decree of Charles III prohibited the giving of reasons for sentences, on the grounds that they gave rise to "cavilings on the part of the litigants", consumed "a great deal of time in the extension of sentences" and increased the costs of the parties. The recovery of the duty to state the reasons for judgments was firstly introduced in the Commercial Code of 1829 and then in the Civil Procedure Act of 1855.
