El escenario judicial y arbitral internacional en el conflicto Ucrania-Rusia

Abstract

El artículo analiza el conflicto Ucrania-Rusia desde la perspectiva del amplio escenario judicial y arbitral que se ha abierto con su existencia. Para ello se argumentan las distintas posiciones de ambas partes ante jurisdicciones internacionales como el Tribunal Europeo de Derechos Humanos, la Corte Internacional de Justicia y tribunales arbitrales. En este punto también se discute el papel de la Corte Penal Internacional y las posibles vías que se plantean en materia jurisdiccional ante la presunta comisión de crímenes que son competencia de este tribunal por medio de su Estatuto. Entre las materias que son controversia ante estos tribunales se encuentran hechos que afectan los derechos humanos, el régimen jurídico de los espacios marinos entre Ucrania y Rusia, entre otros.

The article analyzes the Ukraine-Russia conflict from the perspective of the broad judicial and arbitration scenario that has opened up with its existence. For this, the dif-ferent positions of both parties before international jurisdictions such as the European Court of Human Rights, the International Court of Justice and arbitration tribunals are described and argued. At this point, the role of the International Criminal Court is also discussed and the possible ways that arise in jurisdictional matters before the alleged commission of crimes that are the competence of this court through its Statute. Among the matters that are disputed before these courts are facts that affect human rights, the legal regime of marine spaces between Ukraine and Russia, among others.
