Resumen: | El presente trabajo pretende dar cuenta del surgimiento, desarrollo y alcance de la doctrina del Tribunal Europeo de Derechos Humanos en materia de desalojos forzosos, así como de su incipiente recepción juris-prudencial y legislativa en nuestro ordenamiento. En concreto, el estudio se centra en la facultad de quienes corran el riesgo de perder su vivienda habitual de exigir un examen de proporcionalidad de la medida en sede judicial, analizando los elementos que habrían de integrar este examen y su alcance en las relaciones entre particulares. Por último, el trabajo se ocupa de la recepción de la tutela frente a los desalojos forzosos de vivienda habitual tanto en la doctrina del Tribunal Constitucional y del Tribunal Supremo, como en el Proyecto de Ley por el derecho a la vivienda. This paper aims to provide an account on the emergence, development and scope of the doctrine of the European Court of Human Rights on forced evictions, as well as its incipient jurisprudential and legislative reception in our legal system. Specifically, the study focuses on the power of those at risk of losing their home to demand a proportionality assessment of the measure by an independent tribunal, analysing the requirements that should make up this examination and the limits of its horizontal effect. Finally, the paper covers the reception of the protection against forced evictions in the case law of the Constitutional Court and the Supreme Court, as well as in the Draft Law on the Right to Housing. |
