Violencia machista y circunstancia mixta de parentesco

Abstract

En los delitos de violencia contra la mujer con la que el autor mantiene una relación afectiva, el Tribunal Supremo español ha reconocido la posibilidad de aplicación cumulativa de las agravantes de parentesco y de discriminación por género, argumentándolo con el distinto fundamento de una y otra. Sin embargo, la regulación específica de la violencia machista con respecto a algunos delitos (lesiones, amenazas y coacciones) produce fricciones y desajustes con ambas agravantes genéricas. Para superarlas, se propone una reconsideración global de los factores de parentesco, género y convivencia doméstica en los delitos contra bienes personalísimos, con objeto de establecer cierta coherencia y seguridad jurídica, suprimiendo las regulaciones específicas, acotando el ámbito de aplicación de la agravante de discriminación en razón del sexo y ajustando la agravante de parentesco a lo prescrito en el Convenio de Estambul.

In the crimes of violence against women with which the perpetrator maintains an affective relationship, the Spanish Supreme Court has recognized the possibility of cumulative application of the aggravating circumstances of kinship and gender discrimination, arguing it with their different foundations. However, the specific regulation of sexist violence with respectt o some crimes (injuries, threats and coercion) produces frictions and imbalances with both generic aggravations. To overcome them, a global reconsideration of the factors of kinship, gender and domestic coexistence in the crimes against very personal legal goods is proposed, in order to establish coherence and legal certainty, suppressintghe specific regulations, defining the scope of application of the aggravation of discrimination based on sex and adjusting the aggravation of kinship to the requirements of the Istanbul Convention.
