Los servicios de justicia restaurativa en el Estatuto de la víctima del delito

Abstract

La Ley del Estatuto de la víctima del delito (2014) contempla los servicios de justicia restaurativa y enumera de forma concisa las condiciones de acceso a los mismos: reconocimiento por el infractor de los hechos esenciales, consentimiento previo e informado de la víctima, consentimiento del infractor, procedimiento exento de riesgos para la víctima, ausencia de prohibición legal y confidencialidad (nota característica del procedimiento de mediación). El trabajo explica el papel de la Oficinas de atención a las víctimas del delito en relación con tales servicios y lo que comporta cada uno de esos requisitos de acceso a los servicios de justicia restaurativa. En abundantes notas recoge resoluciones judiciales nacionales y comunitarias, el Manual sobre programas de justicia restaurativa (UNODC), trabajos parlamentarios y maneja la bibliografía al respecto, pese al escaso tiempo transcurrido desde la vigencia legal.

The Law on the Status of the Crime Victim (2014) provides for restorative justice services and concisely lists the conditions for access to them: recognition by the offender of the essential facts, prior and informed consent of the victim, consent of the offender, risk-free procedure for the victim, absence of legal prohibition and confidentiality (characteristic note of the mediation procedure). The paper explains the role of the Crime Victim Assistance Offices in relation to such services and what each of these requirements for access to restorative justice services entails. In abundant notes it gathers national and community judicial resolutions, the Manual on restorative justice programs (UNODC), parliamentary works and manages the bibliography on the subject, despite the short time that has elapsed since the legal validity.
