El dopaje en el deporte. Génesis y actualidad. La Ley frente al dopaje

Abstract

El dopaje en el deporte es el protagonista de esta tesis doctoral. Su análisis se aborda desde tres planos distintos, pero complementarios. En primer término, se hace una inmersión histórica sobre su presencia en la sociedad. El fraude en la competición deportiva es un fenómeno planetario, que atenta contra la salud individual de las personas y contra la salud de toda la sociedad, que prueba el principio de igualdad e infringe los principios éticos del deporte. En segundo lugar, el plano internacional de lucha contra el doping, tanto desde la responsabilidad de las Autoridades Públicas como de las organizaciones privadas del deporte, el denominado Movimiento Deportivo, es objeto de exhaustivo análisis. La regulación contra el dopaje, de raíz internacional pública y del Movimiento Deportivo, tiene la debida consideración en pos de la acción conjunta que ha de prevalecer. Se resalta la acción jurisdiccional del Tribunal Arbitral del Deporte (TAS). En tercer término, el modelo español de lucha contra el dopaje es el eje principal de la tesis. Se analiza el ordenamiento jurídico español desde sus primeros pasos hasta la vigente Ley Orgánica a favor de la protección de la salud del deportista y lucha contra el dopaje en el deporte, tienen tratamiento ordenado y sucesivo hasta culminar la labor revisoría de los Tribunales de Justicia expresada en sus sentencias. Con todo ello, la tesis doctoral aspira a dejar sentado el marco actual del sistema político del dopaje y en lo que afecte a nuestro país, a ofrecer conocimientos sobre la senda por la que ha discurrido el modelo.

Doping in sport is the protagonist of this doctoral thesis. Its analysis is approached from three different, but complementary perspectives. Firstly, a historical immersion is made about its presence in society. Fraud in sporting competition is a global phenomenon, which threatens the individual health of people and the health of society as a whole, and which is a test of the principle of equality and a violation the ethical principles of sport. Secondly, the international level of the fight against doping, both in terms of the responsibility of the Public Authorities and the private sports organizations, the so-called Sports Movement, is the subject of exhaustive analysis. International public anti-doping regulations and those of the Sports Movement are given due consideration in the pursuit of the joint action that is to prevail. The jurisdictional action of the Court of Arbitration for Sport (CAS) is highlighted. Thirdly, the Spanish model of combating doping is the main axis of the thesis. The Spanish legal system is analysed from its first steps to the current Organic Law in favour of the protection of the health of the athlete and the fight against doping in sport, they have ordered and successive treatment until the review work of the Courts of Justice expressed in their sentences. This doctoral thesis therefore aims to establish the current framework of the political system of doping and as far as affects our country, to offer knowledge about the path along which the model has taken.
