dc.description.abstractSus autores explican la nueva regulación del Consejo de la Juventud de España efectuada por la Ley de racionalización del Sector Público en el año 2014. Esta norma legal estatal prevé un absoluto cambio en la filosofía “jurídico-organizativa” de este ente, que abandonará la naturaleza jurídica de organismo público para adoptar la forma de corporación de base privada. Cuatro años después de tal previsión, no obstante, esta transformación no se ha producido, como consecuencia del absoluto fracaso de los dos intentos de desarrollo reglamentario de la Ley de racionalización emprendida hasta el día de hoy. Este libro incluye sendos trabajos académicos, que responden al exhaustivo análisis de cada uno de los dos borradores de Proyecto de real Decreto elaborados por el Instituto de la Juventud, entre junio de 2015 y noviembre de 2017, para desarrollar le regulación mínima contenida en la referida Ley. El fracaso de ambos ensayos reglamentarios, a pesar de la mayor seriedad jurídica del segundo de ellos, se ha debido, muy probablemente, a las evidentes limitaciones de la Ley de 2014, tan poco meditada y tan deficiente –jurídicamente hablando- que el propio Consejo de Estado ha sugerido al Gobierno de la Nación la tramitación de una modificación legislativa para ofrecer un marco normativo adecuado a la nueva realidad a la que deberá hacer frente el Consejo de la Juventud de España en el tiempo futuro.es_ES
dc.description.abstractIts authors explain the new regulation of the Youth Council of Spain made by the Law on the rationalization of the Public Sector in 2014. This state legal norm provides for an absolute change in the “legal-organizational” philosophy of this entity, which will abandon the legal nature of public body to adopt the form of private-based corporation. Four years after such a forecast, however, this transformation has not occurred, as a result of the absolute failure of the two attempts at regulatory development of the Law of Rationalization undertaken to this day. This book includes two academic papers, which respond to the exhaustive analysis of each of the two drafts of the Royal Decree Project prepared by the Youth Institute, between June 2015 and November 2017, to develop the minimum regulation contained in the aforementioned Law. The failure of both regulatory tests, in spite of the greater legal seriousness of the second one, has been, most likely, due to the obvious limitations of the 2014 Law, so poorly considered and so deficient - legally speaking - that the State Council itself has suggested to the Government of the Nation the processing of a legislative modification to offer a regulatory framework appropriate to the new reality that the Spanish Youth Council will face in the future.es_ES
