Resumen: En el presente trabajo realizamos un análisis del protocolo de intimar o exhibir una carta de comisión al juez ordinario. Ello en el contexto de la reforma administrativa de la hacienda iniciada con el conde-duque de Olivares, que continuó avanzando hasta fin de siglo. Nos detenemos en un ejemplo acaecido en 1679, en Huete. En él veremos enfrentarse una garantía del derecho, como tal ejercía la intimación, y con ella todas aquellas garantías que ella misma salvaguardaba, con su limitación por el sistema de referencia de la hacienda, sus ministros y tribunales, cuya acción se adscribía a una potestad económica sin derecho que amenazaba con estar suelta. Se trataba de un conflicto legal que desafiaba un derecho ordinario que desobligaba, a cuyo servicio se colocaba la intimación, y que implicaba a los fundamentos jurídicos de la monarquía.
This article contains an analysis of the protocol for showing or presenting a letter of commission to an ordinary judge. This is in the context of the administrative reform of the tax office, which began with the duke of Olivares, and continued until the end of the century. We visit an incident that occurred in 1679, in Huete. In this incident we will see a legal guarantee, as exerted by this protocol, and with it all those guarantees that it safeguarded, with its limitation by the reference system of the tax office, its ministers and courts, whose action was ascribed to economicae without law. It was a legal conflict that challenged an ordinary law that was without obligation, in whose service this protocol was made, and that implied the legal foundations of the monarchy.
