| Abstract: | Este trabajo analiza los fundamentos de la polémica mantenida entre Carl Schmitt y Hans Kelsen sobre la figura del Defensor de la Constitución. En él se muestran los elementos básicos de las tesis defendidas por cada uno de los autores, así como los principios fundamentales de sus razonamientos. This paper analyses the bases of the Schmitt vs. Kelsen controversy about the role of the «Defender of the Constitution». This article contains a compilation of the essential elements of the theses defended by each one of them and also the fundamental principles of their positions. |
