¿Por qué es necesario interpretar el derecho? Un análisis a la respuesta de Joseph Raz

Abstract

Normalmente nos referimos a la interpretación en el marco de la praxis del Derecho, enfocando nuestros esfuerzos teóricos en averiguar cómo realizar esta actividad. Sin embargo, la interpretación jurídica nos revela datos muy interesantes de su objeto, sobre todo, aclara nuestro conocimiento acerca de su naturaleza. Particularmente, gracias a las indagaciones en torno a la necesidad de la interpretación jurídica, se revelan múltiples datos incardinados en el ámbito de la ontología del Derecho. En esta ponencia se realiza un análisis crítico a la respuesta que ofrece Joseph Raz a la pregunta: ¿por qué interpretamos el Derecho?, poniendo particular interés en los atributos de la autoridad y persistencia de lo jurídico.

Normally we refer to interpretation within the framework of praxis of the Right, focusing our theoretical efforts in finding out how to make this activity. Nevertheless, the legal interpretation reveals very interesting data to us of its object, mainly, clarifies our knowledge about its nature. Particularly, thanks to the investigations around the necessity of the legal interpretation, reveal manifold data in the scope of the ontology of the Right. In this communication a critical analysis to the answer that offers Joseph Raz to the question: why we interpret Rights? , putting particular interest in the attributes of the authority and persistence of the legal thing.
