La frialdad del texto. Comentario al prólogo del “ Fuero Viejo de Castilla”

Abstract

El objetivo es acceder a uno de los textos más conocidos y respetados por los historiadores jurídicos como es el Fuero Viejo de Castilla. Texto este nada inocente, ya que intenta orientar, en favor de los sectores señoriales jurisdiccionales, las relaciones jurídicas existentes en el seno de la sociedad estamental castellana. Se pretende realizar una interpretación en términos de historia jurídica del texto inicial y se intenta sugerir el presumible esqueleto oculto, disfrazado de intereses políticos y jurídicos, que se esconde tras el discurso.

The goal of this article is to have access to one of the most well known and respected texts by legal historians as is the Old Law of Castile. This is a text nothing innocent because it tries to guide, in favor of jurisdictional sectors, legal relations existing within the princely Castilian society. It is intended to provide an interpretation in terms of legal history of the original text and attempt to suggest the presumed hidden skeleton, disguised as political and legal interests, behind the speech.
