Guillermo de Ockham y el origen de la concepción nominalista de los derechos subjetivos

Abstract

Este artículo, a partir de la controversia entre Michel Villey y Michel Bastit, por una parte, y Brian Tierney, por otra, intenta dilucidar si la obra político-jurídica de Guillermo de Ockham introdujo o no un cambio revolucionario en la concepción del Derecho. Concluye que sí dio lugar a cambios profundos y que, a causa de ellos, si bien no puede decirse que el franciscano haya introducido la noción de derecho subjetivo, sí puede decirse que es el fundador de la concepción nominalista de la noción de derecho subjetivo.

This paper tries to determine whether William Ockham’s politico-juridical works introduced a revolutionary change in the conception of Law and right. It departs from a consideration of the debate between Michel Villey and Michel Bastit, on the one hand, and Brian Tierney, on the other. It comes to the conclusion that the Franciscan’s works did bring deep changes. Because of such changes, although Ockham did not introduce the notion of subjective right, one could say that Ockham is the founder of the nominalist notion of subjective right.
