Uso sostenible de los productos fitosanitarios: tipología infractora

Abstract

La regulación de las actividades relacionadas con la comercialización y utilización de productos fitosanitarios comprende la previsión del correspondiente régimen sancionador para los casos en los que se incumplan o transgredan las normas establecidas. En la medida en que la ordenación de este sector tiene por objeto garantizar un elevado nivel de protección de la salud humana y del medio ambiente, así como la libre circulación en el mercado interior de estos productos, la intervención del Derecho sancionador se dirige a castigar cualquier conducta contraria que ponga en peligro estos bienes jurídicos. Este trabajo analiza las consecuencias legales que llevan aparejados los incumplimientos de las reglas dispuestas para ordenar la puesta en el mercado y el uso de los productos fitosanitarios, que pueden ser constitutivos tanto de infracciones administrativas como de delitos penales.

The regulation of the activities concerning the placing of plant protection products on the market and the use of these products includes the forecast of the corresponding system of penalties. To the extent that this sector aims to ensure a high level of protection of human health and the environment, as well as the free movement of these products in the market, the sanctioning law is aimed at punishing any conduct that endangers these legal rights. This paper analyzes the legal consequences of the rules established to order the placing on the market and the use of plant protection products, which can be constitutive of both administrative infractions and criminal offenses.
